Instagram woman wants millions from Japanese food delivery network: EADaily

Singer and blogger Instasamka (Daria Zoteeva) filed a lawsuit against the popular Japanese food delivery network Yobidoyobi. The telegram channel reports this Mix.

The artist plans to receive 3.3 million rubles for the use of her track and image in network advertising. According to the singer, at first the network tried to buy the rights to use Instasamka’s song, it was rejected and he decided to release an offensive parade.

The incident happened back in March this year. The singer’s team noticed the video on the company’s social network page.

“There: a whole clip with the motif “For money – yes,” an actress who is very similar to Instasam and other obvious things,” – the publication says.

A pre-trial claim was sent to the company demanding that everything be removed and compensation be paid for the use of someone else’s intellectual property.

The Yobidoyobi network raised objections that this is a parody, and the social network in which the video was published is banned in Russia, and cannot be considered advertising. The network refused to pay.

“As a result, the singer’s lawyers went to arbitration court. They want compensation for illegal use of their creation and infringement of exclusive rights. The amount is the same: 3 million plus 150 thousand for lawyers and 97.4 thousand for costs,” – tells the telegram channel.

As reported EADailyagainst Alfa-Bank, as well as Instasamka, Moscow launched OFAS (Office of the Federal Antimonopoly Service) case for breaking the “On Advertising” law. The video clip “Alpha Female,” which was published on the YouTube channel Instasamka last November, was considered controversial by the FAS.
