The International Criminal Court (ICC) has rejected this Friday the appeal of the Government of Venezuela to try to archive the investigations for possible crimes against humanity, so the Prosecutor’s Office of said court, headed by Karim Khan, will continue to examine the alleged abuses committed. in the Latin American country following the opposition mobilizations of 2014.

The Venezuelan opposition has repeatedly demanded the intervention of the TPI and in September 2018 a group of countries – Argentina, Canada, Colombia, Chile, Paraguay and Peru – sent a formal request that led to the opening of an investigation in November 2021. formal by the Prosecutor’s Office.

The Executive of Nicolás Maduro has argued throughout the procedure that there have been no widespread abuses and there are already investigations underway in Venezuela, a thesis that has continued to be clung to after the decision of the Pre-Trial Chamber to give the final green light. to the investigations in June 2023.

Now, the Appeals Chamber has rejected the last of these appeals, after examining the arguments presented by the parties in November. It affects, among other issues, the fact that Venezuela has not incorporated into its Penal Code the explicit recognition of crimes against humanity.

Venezuela ratified the Rome Statute in June 2000, so theoretically it must submit to the sovereignty of the court based in The Hague.

REJECTION OF THE VENEZUELAN GOVERNMENT

The Venezuelan Foreign Ministry has expressed its “disagreement” with this Friday’s resolution, since it considers that the process “responds to the intention of instrumentalizing international criminal justice mechanisms for political purposes”, based on “alleged crimes against humanity that have never occurred.”

«This entire maneuver has been built from the manipulation of a small set of crimes that, as evidenced by all the information provided by Venezuela, have been or are being duly investigated and punished by the authorities of the Venezuelan justice system, of sovereign manner as established by the Constitution,” said the department headed by Yván Gil.

Venezuela offers to investigate and prosecute any possible abuse and to collaborate with the ICC investigators, and therefore considers that “it is neither necessary nor appropriate for the Prosecutor’s Office to carry out separate or additional investigations.” It also reserves the right to resort to “all available actions” to “reverse truthfully” these types of decisions.

The Maduro Government has also questioned that the ICC dedicates time and part of its “scarce resources” to continuing with a cause that “undermines its credibility” while “the world watches with horror as the Palestinian people are victims of a bloody genocide before the inaction of the international bureaucracy called to prevent or stop it,” in reference to the Israeli military offensive on the Gaza Strip.
