Karlsruhe/Stuttgart (dpa). – After initial success in shortening construction procedures at the Karlsruhe Administrative Court, special judges across the country should ensure faster decisions. “We are having difficult times in construction and especially in the housing sector,” explained Justice Minister Marion Gentges (CDU).
“It is therefore imperative that we remove barriers as quickly as possible – this includes ensuring quick decisions and results. ” The Greens and the CDU agreed in the coalition agreement that they wanted to establish special chambers in the administrative courts. The long planning time in Germany and Baden-Württemberg is a disadvantage in international competition. Such a construction law room has been operating at the Karlsruhe Administrative Court since the beginning of 2023. Although construction law cases took 16.3 months in 2022, last year it was only 11.9 months. In Karlsruhe, emergency cases were shortened from four to 2.7 months.
According to the court there, the shortening of the proceedings in Karlsruhe is not only due to the concentration of proceedings in one room, but above all to additional staff. According to the ministry, the country has created seven new positions, six judge positions and one for the support sector.
“With the design chambers, we allow judges to specialize, especially in the field of construction law,” explained CDU politician Gentges. “This is an important part in promoting the construction of houses in Baden-Württemberg. Because of specialization, the courts could work even more efficiently and infrastructure procedures could be greatly accelerated, she explained.
