Telefónica del Perú will proceed to pay S/ 1,361 million to SUNAT

Telefónica del Perú reported through a Significant Fact that it will proceed to pay S/1,361 million to the National Superintendency of Tax Administration (SUNAT) in compliance with what was ultimately resolved by the Judiciary in January 2023 for the declaration of the Income Tax for the fiscal years 2000 and 2001.

He also noted that, although the Constitutional Court recognized the company’s arguments regarding the calculation of interest, unfortunately the Judiciary ultimately validated some of the objections made by the tax administration. For this reason, even though Telefónica del Perú is in total disagreement with what was resolved by the Judicial Branch, in respect of the institutions and legal security it will proceed to make the payment under protest. For these purposes, it has instructed the financial entities to, in due course, proceed to pay SUNAT the sum of up to S/1,361 million in honor of the guarantee letters issued within the framework of the indicated processes.

Likewise, for the remaining amounts that may arise from the settlements, a fractionation will be required before SUNAT in accordance with the Tax Code.

Likewise, it reported that on January 17 of last year, it had already notified of the Supreme Court’s resolution and timely complied with the due provision for this contingency.

With the conclusion of this case, which lasted more than 20 years, it affirms its commitment to continue with the deployment of infrastructure and the continuity of its services to consolidate itself as the main ally of the country’s digital transformation.

It should be noted that the company’s main shareholder (Telefónica SA) has been in international arbitration since March 2021 before the International Center for Settlement of Investment Disputes (ICSID) for various conduct by the Peruvian State that violates the Agreement for Reciprocal Promotion and Protection. of Investments between Spain and Peru, which included matters related to these tax issues.
