Congressman Idelso García proposed punishing with life imprisonment those who cause the death of their direct victims or people close to them, through the collection of extortionate loans, known as “gota a gota.”
Bill No. 7516/2023-CR also proposes punishing with a penalty of no less than 15 years nor more than 25 years in prison the crime of extortionate usury, committed by those who grant credits or loans and, using violence , threats and any other act of intimidation, charge disproportionate interest.
In this regard, the aforementioned parliamentarian pointed out that his bill aims to reduce the incidence of the crime of extortionate usury, which puts Peruvians at risk.
The proposal indicates that the so-called “drop by drop” loans are attracting a greater number of victims, as a result of the fact that many Peruvians do not qualify to access loans from the formal financial system.
“The crime of extortionate usury, such as drop-by-drop lending, is not explicitly penalized, not appearing as such in the Penal Code, which has caused the incidence to increase disproportionately, to the point that it constitutes a crime that is potentially affecting more than 3.7 million people,” states the bill.
