The Supreme Court confirms the 9-year sentence given to former manager Di Fazio for 5 cases of violence. He made the victims unconscious with benzodiazepines and then photographed them

The Court of Cassation confirmed the 9 years of imprisonment inflicted in second degree on the former pharmaceutical entrepreneur Antonio Di Fazio, accused of five episodes of sexual violence with the use of benzodiazepines, including the one for which he was arrested in May 2021: for the accusation he had drugged and raped a 21-year-old student lured into his apartment with the excuse of an internship and then photographed her taking advantage of her state of unconsciousness.

The Supreme Court has, in fact, declared inadmissible the appeal of the defense, supported by the lawyer Ivano Chiesa and accepted that of the prosecutor against the decision of the Court of Appeal of Milan to reclassify the mistreatment and sexual violence against his wife in acts persecutors so as to be prescribed. On this chapter, therefore, the stoats have postponed it to a new second degree judgment which could, depending on the outcome, lead to an increase in the sentence.

“I will never be able to understand – declared the lawyer Chiesa – how we can give 8 years to Alberto Genovese for rapes and 9 to my client for photographic sexual violence, i.e. for having taken intimate photos. There seems to be an evident enormous difference in gravity between the two hypotheses, assuming that photographic sexual violence exists”.

The former manager, tried with an abbreviated trial, was given 15 and a half years in prison in the first instance by the investigating judge Anna Magelli who had not recognized the continuation of the crimes. Continuation instead applied by the judges of second instance who last June also acquitted him of kidnapping in relation to the episode of the student and declared that there was no need to proceed for mistreatment, stalking and sexual violence against his ex-wife, a point on which there will be further judgment.

Among the civil party lawyers in the trial are the lawyers Andrea Prudenzano, Andrea Belotti, Gloria Bordanzi, Patrizio Nicolò and Maria Teresa Zampogna, Monica Monteverde and Giorgio Conti. Di Fazio, now in a therapeutic community for his drug addiction problems, should return to prison.
