OpenAI, the renowned research lab focused on artificial intelligence (AI), has found itself embroiled in a legal battle with none other than Elon Musk, the billionaire entrepreneur and CEO of Tesla and SpaceX. Musk filed a lawsuit against OpenAI last week, accusing the organization and its CEO, Sam Altman, of betraying the original mission of developing AI for the benefit of humanity. In response, OpenAI has hit back, slamming Musk’s claims and releasing a series of emails that purportedly show his support for the creation of a for-profit entity.

The dispute centers around OpenAI’s decision to transition from a non-profit organization to a for-profit entity. Musk, who played a pivotal role in getting OpenAI off the ground in 2015, alleges that Altman and others reneged on an agreement that the company’s research would be freely available to the public. He argues that OpenAI has effectively become a subsidiary of Microsoft, which has invested a reported $13 billion in the organization’s for-profit arm.

OpenAI, however, paints a different picture. In a blog post published on Tuesday, the research lab claims that Musk himself pushed for the founders to raise significantly more funding than initially planned. “We need to go with a much bigger number than $100M to avoid sounding hopeless… I think we should say that we are starting with a $1B funding commitment,” Musk wrote to Altman and fellow co-founder Greg Brockman in November 2015. The founders contend that they realized the immense costs associated with developing artificial general intelligence (AGI) – AI systems that can perform as well as or better than humans – necessitated attracting substantial investment.

According to OpenAI’s blog post, it was in late 2017 that Musk and the founders decided to create a for-profit entity. However, disagreements arose over the terms of this arrangement. Musk sought majority equity, initial board control, and the position of CEO, demands that OpenAI felt were against its mission of preventing any individual from having absolute control over the organization. Musk then suggested merging OpenAI into Tesla, proposing that it become the company’s “cash cow.” Ultimately, no agreement was reached, and Musk chose to leave OpenAI, expressing his belief that the organization had no chance of success. He went on to establish his own AI company, xAI, in 2020.

OpenAI’s blog post concludes with a sense of disappointment and sadness. The organization expresses its admiration for Musk, who inspired them to aim higher but then turned against them. OpenAI claims that it has made meaningful progress towards its mission without Musk’s involvement and laments the fact that he has resorted to suing them.

This legal battle between OpenAI and Elon Musk highlights the complexities and challenges associated with developing AI technologies.
