The Central Agency for the Reception of Asylum Seekers (COA) wrongly placed a 35-year-old Algerian asylum seeker in a reduced part of the registration center in Ter Apel, the court in The Hague ruled.
The man ended up in a place for people with underprivileged asylum applications, where, for example, asylum seekers from so-called safe countries stay. Asylum applications from Algeria are generally underprivileged, but the country is not considered safe by the government.
There are fences around the so-called process availability location (PBL) and a strict regime applies. Asylum seekers are required to participate in a day and evening program and are only allowed to leave the site for two hours per day.
Arrange well
According to the court, restrictions on freedom in the reception of asylum seekers are not prohibited, but if the restriction is so great, it must be properly arranged. “That did not happen here,” the court said. The man is entitled to regular shelter until there is clarity about his asylum application.
The COA deliberates according to: RTV North on the judge’s ruling and will decide next week whether to appeal the ruling. It is not clear what the ruling means for other asylum seekers in the PBL.
Pilot
The PBL is one trial shelter which started last year with 25 places. At the location, people with a disadvantaged asylum application can go through the procedure more quickly. This would make them roam less on the streets and cause less nuisance.
The outgoing cabinet announced at the end of last year that the number of places would be increased to fifty within a few weeks.
Last month, a hundred people could be accommodated. Those numbers have not been achieved by a long shot. At the beginning of last month, thirty places had been created.
