An Irish woman’s insurance claim of over $800,000 has been denied after a photo emerged showing her throwing a Christmas tree during a competition. Kamila Grabska, 36, had filed a claim with RSA Insurance, stating that a car accident in 2017 had left her with debilitating pain and unable to perform daily tasks. However, the court dismissed her case after being presented with a photo of Grabska throwing a spruce tree and winning a Christmas tree-throwing contest.
Grabska had claimed that the accident had caused constant pain in her back, neck, and thoracic spine, making it impossible for her to lift groceries, do household chores, or play with her two children. She also stated that she had been unable to work for five years and had quit her job, going on disability. A significant portion of her claim was for past and future lost wages.
However, the court was swayed by the photo taken in January 2018, which showed Grabska happily throwing a large Christmas tree. Judge Carmel Stewart concluded that the claims were entirely exaggerated based on this evidence. The judge stated that the agility and strength displayed in the photo contradicted Grabska’s claims of ongoing pain and injuries.
Grabska denied faking her injuries and insisted that her intention was simply to lead a normal life. She argued that despite appearing happy in the photo, she was still suffering from her injuries. However, the court found this explanation inconsistent with the evidence presented.
In addition to the photo, further evidence was submitted to the court in the form of a video showing Grabska training her dog for over an hour. This further undermined her claims of being unable to perform physical activities due to her injuries.
