Marcos Braz Case Dropped After Victim Retracts Statement: Public Ministry of Rio de Janeiro

The Public Ministry of Rio de Janeiro filed the case against Marcos Braz, Rio de Janeiro councilor and vice-president of football for the Flamengo. The decision came after Leandro Campos, a delivery man and Red and Black fan, gave up on continuing the process.

After new images, the Chamber’s Ethics Council will reevaluate Marcos Braz’s conduct in an episode with a fan in a shopping mall

“The expression of the offended party’s will not to demonstrate interest in continuing with the process leads to the absence of a condition of proceeding for criminal action and the consequent extinction of punishment in relation to the perpetrators of the incident”, says an excerpt from the Public Prosecutor’s statement.

Furthermore, the document signed by Márcio Almeida Ribeiro da Silva, prosecutor, says: “Considering the retraction of the victim Leandro, the Public Prosecutor’s Office promotes the archiving of the files due to the absence of a condition of the action, postulating that the punishment of the perpetrators be declared extinct of the fact and, once the manifestation is accepted, it dispenses with science in honor of the principles of speed and procedural economy”.

On the 7th, Braz and Leandro met again in the office of the director’s lawyer, Rafael Matos, in Rio de Janeiro. The delivery man was accompanied by his mother and lawyer Ani Luizi de Oliveira and accepted the apology.

At the time, the ge also found that Leandro will receive extrajudicial compensation (the amount is kept confidential) and with this he waived the civil action for moral damages and also the criminal representation under article 129 of the Penal Code, which talks about “offending the bodily integrity or health someone else’s.” In turn, Braz gave up the process that intended to classify Leandro, under article 147 A of the Penal Code, which talks about persecution.

It is worth noting that the director also avoided the risk of suspension caused by a group of five members within the club. The Permanent Committee on Legal Affairs of the Flamengo unanimously denied and archived the representation.
