The Indonesian Anti-Corruption Society (MAKI) regrets this Dewas KPK imposed heavy sanctions in the form of an apology by 78 KPK employees who were proven to have been involved in extortion in the KPK detention center. MAKI said that the sanctions had become a laughing stock.
“It is very unfortunate that the action of the KPK Supervisory Board was only to apologize, that is a truly very unfortunate blunder,” said MAKI Coordinator Boyamin Saiman to reporters, Sunday (18/2/2023).
The decision handed down by Dewas KPK That, according to Boyamin, is difficult to understand logically. Because, said Boyamin, extortion is part of corruption.
“I myself find it difficult to understand with reasonable logic, simple logic, what are the reasons and then the interests or motives of the KPK supervisory board in giving sanctions only to apologize? Even though this is clearly extortion, extortion is part of corruption,” said Boyamin.
Boyamin also criticized the KPK Council for stating that the disciplinary process would be carried out by the Secretary General of the KPK. According to him, the KPK Dewas was just looking for excuses.
“In civil service disciplinary matters there cannot be punishment twice, this is the punishment given (sanction) to apologize publicly, that is already a punishment, in fact the same case cannot be punished twice, that is not permissible, for example then being fired, that is not “That’s fine. This is a form of bullying, so apart from being a blunder, this is a form of bullying the Supervisory Board. The Secretary General will not be able to carry out stricter processes or even fire,” he said.
“With the sanction of apologizing, you can no longer be fired because there cannot be two sanctions. If you force it, the perpetrator will sue the PTUN and it is certain that the Corruption Eradication Commission will lose. It’s even worse if the Dewas doesn’t understand that double sanctions are prohibited,” he said.
Value Becomes a Laughing Stock
Boyamin believes that the KPK Council’s decision to order the perpetrator to only apologize will be a laughing matter. Boyamin also highlighted that there was no recommendation from Dewas that this extortion case be investigated criminally.
“There is absolutely no deterrent effect, it has even become a laughing matter. There is also no firmness in recommending a criminal case, unlike in the past gold theft, employees who were deemed to have stolen gold were recommended for criminal proceedings, but now they are not, so there are a lot of things. “which in my opinion is the fault of the KPK Supervisory Board,” he said.
Boyamin hopes that this extortion case will be handed over to be investigated by the police or prosecutor’s office. Because, he said, extortion is part of corruption.
“Therefore, criminal proceedings must be carried out and in my opinion it is no longer appropriate for the Corruption Eradication Committee to handle it, because the Corruption Eradication Committee is part of the problem itself, so it must be handed over to the police or to the prosecutor’s office so that this can be done fairly,” he concluded.
Dewas Sanctions 78 KPK Apologizes
The Corruption Eradication Commission (KPK) Council gave heavy ethical sanctions to 78 of the 90 people who were tried for extortion at the Corruption Eradication Commission (KPK) detention center. The KPK Council also explained why the 78 people were only given heavy sanctions in the form of a public apology.
“I also need to explain, since KPK employees changed to ASN on June 1 2021, the ethical sanctions for employees are only in the form of moral sanctions. In this case, an apology. The hardest thing is to apologize openly and directly,” said Chairman of the KPK Council, Tumpak Hatorangan. Panggabean at a press conference at the ACLC KPK building, Thursday (15/2).
Tumpak emphasized that since KPK employees became ASN, punishment was only in the form of moral sanctions. This is because the maximum sanction for ASN is only a moral sanction.
“That, after changing to ASN, our punishment cannot be other than a punishment called a moral sanction. Because, ethical sanctions on ASN are moral sanctions,” he said.
The Corruption Eradication Committee (KPK) also investigated criminal extortion cases. The case has risen to the current level of investigation. The perpetrators were also processed according to personnel regulations at the KPK Inspectorate.
