The Burgas Court of Appeals confirmed a remand measure taken by the District Court – Yambol to “detain” the Turkish citizen Ferhan U., brought to criminal liability for attempted gold smuggling.
On February 7 of this year, at the border crossing-Lesovo, Yambol region, without the knowledge and permission of the customs authorities, the foreign citizen attempted to transport goods for commercial purposes in large quantities across the state border of our country, from the Republic of Bulgaria to the Republic of Turkey – 10 pieces of gold bars and castings with a total weight of 4056 grams and a total value of BGN 380,697.04. The act is classified as a serious intentional crime under Art. 242, paragraph 1, b. “e” in accordance with Article 18, Paragraph 1 of the Criminal Code, which is punishable by imprisonment from three to ten years, as well as a fine from BGN 20,000 to BGN 100,000.
The appellate instance shares the conclusion of the first-instance court that from the evidence and evidence gathered during the pre-trial proceedings, a reasonable suspicion can be made that the accused committed the crime. The appellate judges also accept the existence of a real danger that he will abscond, given the fact that he is an international driver and constantly travels around Europe, has no permanent and current address in the Republic of Bulgaria, and lacks permanent, temporary or casual employment in our country.
The Court finds that the present remand measure “detention in custody” is lawful and will contribute to achieving the intended goals of the measure by ensuring the conclusion of the criminal proceedings within a reasonable time.
The decision of the Court of Appeal – Burgas is final.
