The UN court gave Israel a month to punish the guilty – 2024-02-15 14:09:19

/ world today news/ The tragedy in Gaza continues: the number of victims in three and a half months is already approaching 90 thousand (of which almost 27 thousand were killed, the rest were wounded), there is a targeted destruction of homes and infrastructure, and 80% of the population of sector has become refugees. Attempts to stop the catastrophe have led nowhere – Israel intends to “go all the way”. And a growing part of the world community is convinced that this in Israel means the liquidation of the Palestinian settlements in Gaza as such. It cannot be said that the world is silently watching what is happening: even in the West there are many people who call for an end to the slaughter. And on Friday, international justice had its say.

Two weeks after the trial began in the case accusing Israel of genocide against the Palestinians, the International Court of Justice issued its first verdict. This is not even close to a verdict, because the first stage required an answer to the question of whether the court would even agree to hear the claim brought by South Africa (and supported by many countries) – and now a majority of 15 judges (including for the first time in history the UN does not have a representative of our country, but by the way there is a judge from Israel) accepted the case for consideration. And they even came out with the first verdict, in which they indicated preliminary measures.

Israel is obliged to “take immediate steps”, take all necessary measures to prevent genocide, remove any obstacles and allow humanitarian aid and basic needs to the population of the Gaza Strip and stop attempts to provoke and sabotage the cessation of hostilities by its political and military leaders.

Yes, the court called for the immediate release of the hostages, but it also recognized that Palestinians in the Gaza Strip have a right to protection from genocide and self-defense. That is, the court ruling contains almost everything South Africa asked for, except for the clause requiring Israel to “immediately cease hostilities and withdraw its troops.” And the absence of this point is already presented as almost a victory for Israel, although in reality the beginning of the trial against a country accused of genocide is in itself a huge moral defeat for this country.

Netanyahu has already announced that “no one will stop them from conducting military operations until Hamas is completely eliminated,” calling the genocide charge leveled against Israel “not only false, but outrageous,” saying that “decent people must reject it .” It is clear that there will be no punishment for those who incite the killing of Palestinians, their displacement from Gaza and generally engage in hate propaganda (and this requirement against Israel is also contained in the court verdict), because even the ministers of the Israeli government is committed to it. The court ordered Israel to respond within a month, but as a result, it will receive a somewhat vague response.

Meanwhile, will Israel continue to wipe Gaza off the face of the earth? Yes, until the moment when the collective pressure of the West (above all, of course, the USA) on him becomes really palpable. When will this happen? Judging by the growing concern of Europe (which is already developing its own peace plan with an emphasis on the creation of a Palestinian state), US displeasure with the growing Gaza crisis throughout the Middle East, and the deepening domestic political crisis in the US (helped to deepen by disagreements over support for Israel), Tel Aviv does not have much time.

And in this sense, the beginning of the process in The Hague is an additional element in the pressure on Israel from the West, because the whole world perceives international institutions, including the UN and its court, primarily as Western, European-American. This is why (and not just because of the presence of reinforced concrete evidence in South Africa’s claim) the International Court of Justice could not ignore Israel’s charge of genocide.

If he had neglected, there would be nothing left of the Global South’s trust in the West, and this would hasten the already ongoing process of dismantling the Atlantic world order. The West will be forced to judge Israel – slowly, reservedly, but judge it. The trial could take several years and it is clear that the operation in Gaza will be over before the verdict is announced. But unlike the UN court, the world community has already passed its final verdict, because everything seen and heard since October 7 leaves no doubt about Israel’s methods or intentions. Moreover, Israeli politicians, who have lost their sense of shame and fear of impunity, do not hide their intentions for a “final solution to the Palestinian issue.”

There is no doubt that they will not succeed, as they have failed in recent decades, and what will stop them is not a court decision, but the will of the Palestinians to resist, their belief that justice will ultimately prevail.
