Legal Battle Ends: Real Estate Program in Landerneau Back on Track

For eighteen months, the real estate program started on rue de la Petite-Palud, in Landerneau, remained at a standstill. Many even thought it was abandoned. It must be said that the construction site looked sad. On site, the presentation panel, lying on the ground, had been drinking for a while already.

“At one time, a real estate company with which we have nothing to do was interested in this land. Considering that she would have been dispossessed of this file, she decided to deposit a provisional legal mortgage in the amount of €900,000 when the work had just started,” explains Patrick Dursent, project leader.

Mortgage lifted

This procedure happened at the worst time. “The construction site has been stopped. At the time, eleven of the fifteen accommodations had been reserved. But the funds advanced by the future owners were blocked,” continues the architect.

It took eighteen months of legal battle for this mortgage to be lifted. “Once it had been issued, it could only be challenged in another court. This mortgage was finally lifted on November 10, 2023 by the Rennes Court of Appeal,” Patrick Dursent further specifies.

We’re going back for a ride

The latter finally ensures that the buyers who had declared themselves have all regained their stake. “They recovered their money committed for the reservation, i.e. 5% of the total cost of the accommodation, because the deeds of sale had not yet been signed,” concludes the promoter. But, obviously, these investors have since moved on. It is therefore appropriate to attract new ones at a time when the marketing of the residence has been relaunched.
