Guayaquil Ordinance Regulates Installation of Bars and Gates for Security Measures

An ordinance regulates the type of bars or security gates that can be installed in Guayaquil, in order to protect against crime.

The installation of bars or gates in the neighborhoods of Guayaquil, like a security measuresis regulated in the ordinance that the Cantonal Council approved in the second debate at the beginning of January 2024.

This regulation arose after a controversy between the Municipality of Guayaquil and the residents of sectors, such as The Ceiboswho months ago installed bars on public roads to protect themselves from insecurity.

The ordinance contemplates three types of metal gates that neighbors can install, after obtaining a permit.

For them, an annual royalty rate of between USD 23 and USD 46, between 5% and 10% of a basic salary, depending on the type of road intervened.

This payment is only during the year and is divided among all the houses that are inside the enclosure.

  • Metal gates for pedestrian paths

    The structure must contain two folding doors of a width up to 4.5 meters for free access of emergency vehicles and basic services.

    One of the doors must be folding, with a width of one meter and one height of two meters, for free pedestrian access.

  • Metal gates on vehicular streets with sidewalks less than 1.5 meters

    These gates must have two folding doors with a width of up to 6 meters for vehicular access.

    It must also include at least one folding door with a width of one meter and a height of two meters for free pedestrian access.

  • Metal gates on vehicular streets with sidewalks of 1.5 meters or more

    These gates must have folding doors of a width up to 6 meters for vehicular access and at least one folding door one meter wide and two meters high placed on any of the sidewalks, for free pedestrian access.

In all three cases, the gates must be metal and the height cannot be greater than 2.80 meters, measured from sidewalk level. The height and design of the structure that will support the folding gate will depend on the configuration of the adjacent enclosure or building.

Furthermore, the pedestrian doors may not contain any element that obstructs traffic of people with reduced mobility.

They are completely prohibited barbed fences or any additional element on the top of the gates.

Additionally, they can only be painted in three colors: black, white or olive greenas detailed in the ordinance.

What happens if there are already bars in my neighborhood?

The ordinance gives a period of six months so that communities that have previously installed security elements are regularized.

The neighbors must meet the requirements according to each structure and undergo the procedures to obtain the temporary permit. The six months are counted from the date of publication of the ordinance in the Official Registry.

Obligations for those who install bars

Citizens who obtain temporary permission to install bars or gates must comply with certain obligations established in the ordinance:

  • Guarantee accessibility to public and private entities linked to the emergency care and services during 24 hours.
  • Guarantee vehicular and pedestrian traffic from the 6:00 until 20:00from Mondays to Sundays.
  • Allow the waste collectionrespecting the schedules and frequencies established for the sector.
  • No charges may be made for the passage of people or vehicles.
