Desislava Atanasova to Answer Most Questions at Parliamentary Hearing

She will answer the most questions at the parliamentary hearing

There is no reason for Desislava Atanasova to withdraw from the case regarding the changes in the basic law if she becomes a constitutional judge. This is what Justice Minister Atanas Slavov thinks.

The head of the GERB group is one of the candidates for the two seats in the Constitutional Court, along with judge Borislav Belazelkov, nominated by PP-DB, and lawyer and MP from “Vazrazhdane” Tsveta Rangelova. After Atanasova’s nomination became official, political opponents and lawyers talked about how she should defend herself in this case, since she is one of the authors of the changes. There are two complaints against them in the Constitutional Court – a joint one by “Vazrazhdane” and “There is such a people”, as well as by President Rumen Radev.

“I do not agree with this thesis. There is no such requirement. It is very important that the constitutional changes, as they were adopted, be protected by the SC itself. I don’t expect her to recant. He should not be deprived of participation in this perhaps the most important case of the year in the Constitutional Court”, said Slavov to bTV. Atanas Slavov

The three candidates will have to answer 23 questions from lawyers and journalists during their hearing on Thursday. Most of them are addressed personally to Atanasova, two are precisely whether she will give up the cases about the constitution. Such a question also applies to Rangelova, as she is among those complaining about the amendments.

Atanasova also has the question of whether she has the necessary judicial experience and how she will convince lawyers that she will be an impartial judge despite her long political career. Her opinion is also requested on the direct constitutional appeal, which was dropped from the final amendments to the basic law.

The Bulgarian Institute for Legal Initiatives asked the most questions – 19, among them about judicial independence and the ethical aspects of their work, about their legal expertise, whether there are constitutional provisions of other countries that would be relevant in our country.

The three candidates are addressed by Ivaylo Dermendzhiev – chairman of the Supreme Bar Council, who asks them if they will allow him and the ombudsman to address the CC for a wider range of issues concerning the rights of citizens.
