In the UK, the nicotine vaping industry has introduced a self-regulatory code of conduct with the aim of voluntarily regulating the industry. This code includes comprehensive rules on product names, design, advertising and sales, specifically to address concerns about minors accessing and experimenting with electronic cigarettes. The Code of Conduct serves as a tool for responsible industry operation, ensuring protection for minors and creating a positive impact on society and the environment
The Code of Conduct includes the following requirements:
1. Ensure compliance with UK regulations when supplying products and if
if necessary, notify the supervisory authorities.
2. Not to supply products with brands or names that aim to profit from
for well-known food, beverage, confectionery, cartoon or entertainment brands
(eg Skittle, Prime, Fantasi, Coke Cola, Jolly Ranger).
3. Avoid supplying products whose flavor names are associated with known foods,
for beverage, confectionery, cartoon or entertainment brands (e.g. gum
bear, Haribo, Orio, Red Bull).
4. Only supply products with flavor names that accurately reflect the flavor profile and
do not attract children’s attention with abstract names (eg “dragon’s blood”, “unicorn
cocktail”, “rainbow explosion”).
5. Only deliver products that do not feature cartoon characters or fictional entertainment characters,
which are mainly intended for young people.
6. Only deliver products that do not resemble toys, drink containers, water bottles or others
forms that might interest young people.
7. Implement due diligence measures in supply chains aimed at reducing product
supply to retailers who do not have experience in selling aged products
restriction or do not have strict age verification protocols. These could include
notification of regulatory requirements to wholesale customers and best practice guidance
providing guidance on how to perform the tests contained in the regulations.
8. To comply with obligations in accordance with waste and recycling regulations in own companies and
communicate retailers’ responsibilities to retail customers.
A large part of the industry has already joined the Code, representing more than 50% of the United
of disposable nicotine vaping products on the UK market. Compliance with the Code is monitored
