The judge stated that he was a former official from the Directorate General of Taxes at the Ministry of Finance Rafael Alun Trisambodo proven to have received gratuities worth IDR 10 billion. Rafael Alun received the gratification via PT ARME.
Presiding judge Suparman Nyompa initially outlined the prosecutor’s demands regarding the gratification money received by Rafael Alun through PT ARME, PT Cubes Consulting, PT Cahaya Kalbar, and PT Krisna Bali International Cargo. In his decision, the judge said that Rafael was only proven to have received gratification of IDR 10 billion through PT ARME.
“The defendant was actually and legally active at PT ARME only in 2006, marketing fee “The amount that can be accounted to the defendant is only Rp. 10,079,055,519 until 2006,” said the judge during a hearing at the Jakarta Corruption Court, Monday (8/1/2024).
“As the defendant controlled PT ARME in 2002-2006, the defendant must be legally responsible,” he added.
The judge stated Rafael Alun not proven to have received gratuities through PT Cubes Consulting, PT Cahaya Kalbar, and PT Krisna Bali International Cargo. The judge stated that Rafael only carried out buying and selling transactions software at PT Cubes Consulting and has nothing to do with his position as a tax officer.
“Buying and selling is the core or core business PT Cubes Consulting, buying and selling software “There is absolutely no connection or correlation with the Defendant’s position as a tax official, so the presence of money coming in and out of the PT Cubes Consulting account cannot be taken as evidence indicating that the money from the PT Cubes Consulting account is a gratuity to the Defendant,” said the judge.
The judge also stated that there were no gratifications in buying and selling houses through PT Cahaya Kalbar. The judge stated that Rafael was indeed buying and selling houses in Srengseng, West Jakarta. The judge also stated that Rafael Alun was not proven to have received gratuities from PT Krisna Bali Internasional Cargo.
“Regarding PT Cahaya Kalbar, considering that the public prosecutor in his indictment, page 10 and his letter of indictment, explains that the Defendant received money amounting to IDR 6 billion which was disguised as the purchase of land and buildings in the Taman Kebon Jeruk housing complex, block G1, kav 112, Srengseng Village, Kembangan, West Jakarta ,” said the judge.
“In the opinion of the panel of judges, taking into account the evidence presented in the trial, it turns out that there is no valid evidence to support the sale and purchase of the house and land as a gratuity or gift from the taxpayer to the defendant as a tax official,” said the judge.
Rafael Alun Sentenced to 14 Years in Prison
Rafael Alun Trisambodo was found guilty of receiving gratuities and committing the crime of money laundering. Rafael was sentenced to 14 years in prison and a fine of IDR 500 million.
“Sentenced the defendant Rafael Alun Trisambodo to 14 years in prison,” said presiding judge Suparman Nyompa at the Central Jakarta Corruption Court, Monday (8/1).
The judge said Rafael Alun was proven to have received gratification of IDR 10 billion through PT ARME. Meanwhile, the allegations of gratification from a number of companies mentioned in the indictment were declared not proven.
The judge also stated that Rafael Alun was proven to have committed TPPU. Rafael is said to have disguised the results of his corruption.
The judge stated that Rafael had violated Article 12B in conjunction with Article 18 of the Corruption Eradication Law in conjunction with Article 55 paragraph 1 of the Criminal Code and Article 3 paragraphs 1a and c of Law Number 25 of 2003 concerning the Crime of Money Laundering in conjunction with Article 55 paragraph 1 to 1 of the Criminal Code in conjunction with Article 64 paragraph 1 of the Criminal Code and Article 3 of Law Number 8 of 2010 concerning Prevention and Eradication of TPPU.
