SpaceX Files Lawsuit Against National Labor Relations Board Over Firing Employees

SpaceX on Thursday filed a lawsuit against the National Labor Relations Board, which accused the rocket and satellite manufacturer of unfairly firing employees after they sent a letter to company executives in which they described CEO Elon Musk as a “distraction and embarrassment.”
SpaceX said in the lawsuit filed in federal court in Brownsville, Texas, that the formation of the National Labor Relations Board violates the US Constitution.
The National Council accused the company headed by the American billionaire of violating the federal labor law after expelling eight employees in 2022 for signing the letter in which it was stated that Musk made comments that contradicted the company’s policies. Because of the discrimination it carries regarding gender.
The American administrative judiciary is scheduled to consider this case, before it is also examined by a five-member council appointed by the US President, and the council’s decision may be appealed in a federal court.
SpaceX’s lawsuit aims to block the National Labor Relations Board’s lawsuit, and a spokeswoman for the board declined to comment on the news.
SpaceX had previously resorted to a similar maneuver to disrupt an administrative lawsuit filed by the US Department of Justice in which it accused the company of discriminating against refugees and asylum seekers in its employment policy.
In November of last year, a federal judge in Brownsville, where the lawsuit was filed yesterday, temporarily halted the Justice Department’s lawsuit until the lawsuit filed by SpaceX was completed. The judge said that the US Constitution requires that administrative judges be appointed to the Ministry of Justice by decision of the President, and not the Attorney General, as they are currently appointed.
