Roberto Rodríguez, a 49-year-old construction worker and father of three, was killed by a Tesla car while leaving a party in Harlem when for unknown reasons he lay down in the street.
Rodríguez was walking home around 4:30 a.m. on Sunday, December 31. after his brother’s birthday party when he was fatally struck by the driver of a 2023 Tesla sedan heading north out of town after landing on Third Ave. near E. 110th St., according to a preliminary report from the police collision investigation team from New York.
He was two blocks from the party and just one block from his home in East Harlem when he was hit, he said. Daily News. Paramedics took Rodriguez to Mount Sinai Morningside, where he died.

A police department spokeswoman did not explain how detectives determined that Rodriguez had gone to bed on 3rd Avenue.
“[La policía] “He never mentioned that to us,” said Anahí Rodríguez, her oldest daughter, 21 years old. “We all assumed my dad was walking down the street and got hit. Now we wonder why he was lying there.” She was sleeping at her mother’s house when police knocked on her door around 6 a.m. Sunday with news of her father’s death. She “she felt unreal…she was full of emotions. I never thought about the idea of my dad dying. He didn’t seem real.”
The Tesla driver, an unidentified 25-year-old man, fled after the accident, but returned to the scene a short time later and was not arrested.NYPD reported.
Anahí was with her father until a few hours before the fatal accident, when she dropped him off at a birthday party at her uncle’s house around 1:30 a.m. Sunday, she said. “That was the last time I spoke to my father.” The family shared a photo of Rodríguez smiling with his family at that meeting about three hours before he was killed by a car.

The authorities remember that there is zero tolerance for drivers who drive at excess speed and/or under the influence of alcohol and drugs..
Last month the New York Governor Kathy Hochulsigned the “Angelic Law”, intended to keep drivers with prior suspensions off the road by charging repeat offenders who operate vehicles after committing five or more traffic violations that resulted in prior suspensions or revocations as a felony.
Traffic accidents are a great challenge in New York and In many cases the drivers flee. This despite “Vision Zero” road safety plan created in 2014 by then-new Mayor Bill de Blasio, who promised to make the city safer for pedestrians, cyclists and motorists with a goal of zero deaths by 2024. According to the NYPD, cyclist deaths increased 260% in the first six months of 2023 and 325% since the implementation of the “Vision Zero” plan in 2014.
