Three of the accused have already been released. Now the Court of Appeal will also release the 28-year-old who is still in prison.
The public prosecutor has appealed the decision to the Supreme Court, the defenders say.
– Our client is relieved that the Court of Appeal has concluded that he too will be released from custody in the same way as the other accused in the case, says lawyer Thomas Randby of Elden Advokatfirma to VG.
The 28-year-old was arrested at Rena in September. He was the first to be arrested in the case, and a whole month had passed from the time of the murder until the man was arrested.
The police have believed that it was the 28-year-old who tricked Henriksen up to the cabin where he was found dead.
The man has denied criminal guilt for the murder. So have the other accused in the case. Three of the other accused were released on 20 December. The charges were nevertheless upheld.
– I have had a telephone meeting with all those left behind by Jonas and they react very strongly to this release. They had difficulty accepting that the supposed ringleader was previously released, says the family’s legal aid lawyer, Marijana Lozic to VG.
It is not only the bereaved who have reacted to this, but also the extended family, friends, people in the local community, says Lozic:
– They find it offensive that people who have harassed Jonas for such a long time, and something that ends in murder, are now to be released before the case has been answered in the legal system.
– I notice that the Court of Appeal has split into a majority and a minority, where I support the minority’s statement that a release will offend the public’s sense of justice, she says.
30-year-old Jonas Henriksen was found shot dead in his car at a cabin in Nes in Ringerike on 17 August this year. The police have stated that the 30-year-old had the status of offended in several cases that have been or are under investigation. From March to August this year, eleven notified cases were registered.
The police have apologized to the family, who believe the murder could have been prevented if the police had investigated the reports more thoroughly.
Earlier this month, a man in his 30s was charged with criminal damage in connection with the murder investigation. He is not charged with the murder itself or complicity in it. The man is abroad and will be arrested when he arrives in Norway.
