An American court has just relaunched the case involving the photo of the baby on the cover of the album Nevermind, by the group Nirvana.
A very famous baby who hopes to win his case in court. The most famous baby in rock history, because he was on the cover of Nirvana’s 1991 album Nevermind. It was a photo of a four-month-old baby boy swimming underwater. , naked, trying to grab a $1 bill.
The baby’s parents were friends of the photographer. They agreed to have their child pose in a swimming pool in exchange for $200. From hand to hand… The album Nevermind was released a few months later and was a hit, with 30 million albums sold, number 1 in the United States and in France with the song Smells like teen spirit, sung by Kurt Cobain.
Three million dollars claimed by the grown-up baby
Today, the baby pictured in the album has grown up. His name is Spencer Elden, he is 32 years old. And for a long time, he was just quite proud of the fame he experienced. He gave interviews, he even agreed to pose as an adult in the same position, that is to say naked in a swimming pool. But for some time he has also said to himself that the 200 dollars his parents received was not a lot to pay.
He therefore filed a complaint on the pretext that this photo was of a child pornographic nature. Twice, the American justice system rejected his complaints because the facts were too old. But a US federal court has just relaunched the case. The judges considered that there is no statute of limitations because the album continues to sell. The court did not rule on whether this photo was pornographic or not but opened the way to a new trial.
Spencer Elden is demanding $150,000 from around fifteen people, the producers, the photographer and members of the group Nirvana, including Kurt Cobain’s widow, Courtney Love. He is therefore asking for a little more than 3 million dollars in total, for what he now considers to be damage: having been seen very small, completely naked.
