The final version of the DNU of economic deregulation that Javier Milei signed meant a step backwards with the president’s initial idea of breaking up the business of lawyers in divorces by common agreement.
The journalist Jorge Liotti revealed in The Nation Sunday that in the original version of the megadecree prepared by Federico Sturzenegger, the elimination of binding divorce was included, a law promulgated by Raúl Alfonsín in 1987 that met with fierce resistance from the Church.
The only unofficial voice that came out to refer to this matter was that of Lucas Llach, Sturzenegger’s former vice president at the Central Bank during the first years of Mauricio Macri’s government.
“The only thing that was discussed is the possibility that non-conflictual divorce does not require the intervention of lawyers. One more kiosk, bah,” said Llach, who participated in the last weeks of Milei’s cabinet meetings.
With his clarification, Llach confirmed that Milei should have backed down from an initiative that would have unleashed a war with lawyers dedicated to family law.

Sources from that sector explained to LPO that those who divorce must pay between 5 and 15 percent of the assets to be divided between the former couple in lawyers. Usually 10 percent is negotiated.
“A marriage that separates on good terms, agrees on the division of assets, custody and child support, still has to pay 10% to the lawyer,” the sources said. “They can end in the best way but if they had a million dollars to share, 100 thousand should go to the lawyer,” they added.
Several of the comments that Llach received referred to property successions that, despite being on good terms, also require the mediation of lawyers.
During the government of Carlos Menem, Minister Domingo Cavallo also wanted to deregulate the notary business with decree 2284 of 1991. Cavallo could not and Milei, who defines himself as a disciple of Menem’s Minister of Economy, apparently he won’t be able to either.
Milei would have clashed with the “caste” of law firms that, as LPO anticipated, were behind the drafting of the DNU.
