The real estate mogul’s lawyers appealed the decision to a federal appeals court and Smith then asked the Supreme Court to intervene.
With the court’s rejection of Smith’s request, the appeals court will take over the case, which may delay Trump’s trial in this case.
The appeals court set a start date for hearings on January 9.
Trump’s defense has persistently sought to delay this trial until after the November 2024 elections, arguing that the former president enjoys “absolute immunity” and cannot be prosecuted for his decisions while he was in the White House.
The 77-year-old Republican and favorite for the Republican presidential nomination, was accused in August of trying to alter the results of the November 2020 election, which Democrat Joe Biden won, in a coordinated effort that led to the riot by part of his followers on January 6, 2021 against the Capitol.
