Former Constitutional Judge Advocates for Dual Citizenship in Bulgarian Public Service

If you can be a minister with dual citizenship, why not be a magistrate with dual citizenship? Why not be the head of the BNB or DANS, or DAR, or “Military Intelligence”? These questions were asked on the air of the program “Bulgaria, Europe and the world in focus” on Radio “Focus” by the former constitutional judge Prof. Plamen Kirov .

“Do you know how many positions in the Ministry of Defense and the Ministry of the Interior are reserved only for persons who are only Bulgarian citizens? Then it means that we should wide open the door for dual citizens to occupy these positions. When you allow for the people’s representatives and ministers, on what grounds will you prohibit magistrates from having dual citizenship, DANS employees, heads of DANS, DAR, etc., etc. Notaries are the same way – why should they be only Bulgarian citizens? Such restrictions created by law can be attacked as unconstitutional since the principle in the Constitution is violated, i.e. that dual citizens can occupy the highest echelons of power in Bulgaria and exercise power. Moreover, that our Constitution, as far as citizens’ rights are concerned, is built on the principle of equality and non-discrimination,” the former constitutional judge pointed out.

In his words, no Balkan country allows such a thing: “For obvious reasons – from the point of view of the history of the national states of the Balkan Peninsula. There are over 10 laws in Bulgaria that are related to the structuring and staffing of the state administration, including the the judiciary, which require the relevant positions to be occupied by persons who are only Bulgarian citizens. For example, you cannot be a judge, prosecutor, or investigator if you have dual citizenship”.

According to Prof. Plamen Kirov, it is no wonder that there will come a moment when the people’s representatives deeply regret what they have done within a week: “One cannot be more equal than the other, as Orwell says in “Animal Farm “.
