The recent new episodes of TVB’s national security law information program “Securing the Country with Law” mainly focus on judicial arrangements, such as the reasons why juries are not required to hear national security cases, the trial procedures and time of national security cases, and how the trial procedures reflect the independence of Hong Kong’s judicial system sex.

As we all know, national security cases can be heard by a three-judge panel under designated circumstances without the need for a jury. The eighth episode of “Securing the Country with Law” invited people from the legal profession to allow the public to hear professional analysis of relevant arrangements.

According to the Hong Kong National Security Law, the Secretary for Justice may instruct the Court of First Instance of the High Court to hear national security law cases without a jury on the grounds of protecting state secrets or ensuring the personal safety of jurors. And the trial court consists of three judges.

Ko Lai-man, a legal scholar at the University of Hong Kong, said that common law countries such as the United Kingdom, Australia, and New Zealand do not have juries when handling national security or serious cases. He said that there is only one judge in Northern Ireland trials, and it has been 50 years since 1973 to hear terrorist cases. Most common law jurisdictions in Asia, such as Singapore and Malaysia, have abolished the jury system because of the risk of jury intimidation and bias.

Gao Liwen, a visiting professor at the School of Law of the University of Hong Kong, said that common law countries such as the United Kingdom, Australia, and New Zealand do not have juries when dealing with national security or serious cases.Video screenshot

Former Court of Final Appeal judge Lit Hien-lun believes that the arrangement of three judges to hear national security cases can better protect the trial process and prevent the jury from influencing the verdict due to outside information.

Episode 9, “Trial Procedures and Time,” mainly explores the causes and circumstances of postponements in various cases in Hong Kong courts, and under what special circumstances, private trial arrangements are considered for national security cases.

According to the 2022 Annual Report of the Judiciary, it took an average of 350 days for criminal cases in the District Court last year from the first mention of the defendant in the District Court to the hearing. Criminal cases in the Court of First Instance of the High Court take an average of 323 days to be heard.

Why is it taking so long? The judiciary explained that due to the impact of the epidemic, some cases need to be rescheduled. Courts at all levels need to deal with a large backlog of cases, especially those related to the social events in 2019, and these will take time to process.

Cases related to national security are relatively complex in nature, and some cases involve many defendants, legal representatives, and a large amount of video footage. Trials generally take longer and waiting times are inevitably affected.

Former permanent judge of the Court of Final Appeal, Lit Hin-lun, believes that compared with relevant laws in the United States, the “Hong Kong National Security Law” appears to be more fair and enlightened.Video screenshot

The judiciary strives to prioritize these complex cases. Of the more than 2,220 social incident cases that have been submitted to the courts for trial, about 1,950 have been handled, or nearly 90%. Of the approximately 165 national security cases, approximately 130, or approximately 80%, have been handled. The national security-related cases mentioned above are tried in public like other cases.

Episode 10 “The Independence of Hong Kong’s Judicial System” mentioned that since the implementation of Hong Kong’s national security law, some people have been questioning that the arrangement of designated judges to hear national security-related cases will undermine Hong Kong’s judicial independence. But in fact, the British National Security Law also includes a system of designated judges for trial, which reflects that this is by no means unique to the Hong Kong National Security Law.

At present, many cases related to the National Security Law have been concluded in Hong Kong, and Hong Kong courts have always followed common law principles in hearing relevant cases.

Gao Liman, visiting professor at the School of Law of the University of Hong Kong: “The presumption of innocence is still adopted. This is very clear in the Hong Kong National Security Law. Therefore, the prosecution needs to prove that to convict beyond reasonable doubt, the defendant does not need to prove his innocence.” Video screenshot

Former Permanent Judge of the Court of Final Appeal, Lit Hin-lun: “In fact (the provision mentions) the trial is conducted by a common law court, and the presumption of innocence has been established.” Screenshot of the video.
