Oxfam Novib and other civil society organizations had taken the Dutch State to court. They believe that the transit of the parts violates the laws of war, because the Netherlands knows that the fighter planes for which they are intended carry out attacks on the Gaza Strip. The Netherlands therefore contributes to human rights violations, the organizations believe.
The outgoing cabinet decided at the end of November to continue supplying the parts, partly so that Israel can use the devices against “threats from the region”. Minister Schreinemacher also said that the Netherlands does not supply weapons. “These are American parts, which are stored in the Netherlands and are intended for F-35 partners, in this case Israel.”
The judge finds that the minister has weighed the relevant interests and “could reasonably arrive at her considerations and actions”.
