Lawyer for former Peruvian president proposes to annul judicial sentences – Prensa Latina

The lawyer, Elio Riera, maintained that, in due course, he will request the annulment of the sentences handed down in 2009 by the Supreme Court against Fujimori, for the massacres of Barrios Altos and La Cantuta, for an extermination squad of terrorism suspects, for an aggravated kidnapping and corruption.

Although these sentences were ratified in all instances and are considered exemplary internationally, he maintained that Fujimori is innocent of the crime of direct responsibility for the massacres – whose perpetrators he decorated and granted amnesty – and of the crimes committed in the other cases.

If he achieves his objective, Fujimori will not have to pay reparations to the State for 15 million 400 thousand dollars and to relatives of the victims of La Cantuta and Barrios Altos for 420 thousand dollars, which he has refused to comply with, alleging insolvency.

The young lawyer also maintained that he will also annul the pending cases, apparently encouraged by the order of the Constitutional Court, to release Fujimori after reviving a 2017 pardon declared illegal by the Judiciary, revalidated by the TC and blocked by the supranational justice in 2022.

Among these processes, whose trial requires authorization from the Chilean justice system, which extradited Fujimori in 2007 for specific cases, includes the mass sterilization of poor and indigenous women, without authorization from the victims.

He also said he was sure that he would be able to defeat the request of the Prosecutor’s Office specializing in human rights, that Fujimori be placed under house arrest.

The request seeks to guarantee his appearance in a trial for a massacre of six farmers in Pativilca, 210 kilometers north of Lima, by the same death squad responsible for the massacres for which the former ruler was convicted.
