Initiative Law to Protect Tenants from Usury Practices by Landlords: Senate Debate and Vote Updates

The initiative law by GroenLinks/PvdA Member of Parliament Henk Nijboer and CU Member of Parliament Pieter Grinwis should better protect tenants against usury practices by landlords. The intention is that the law will put an end to the possibility of saying goodbye to tenants after two years and at the same time significantly increase the rent for the next residents.

Especially in large cities, such practices have made housing in the private sector unaffordable. In the House of Representatives, 112 of the 150 members, including the members of BBB and CDA, therefore voted in favor of the initiative law. This made it seem like a done course, but the discussion in the Senate today made it clear that the stakes are high.

Side landlords

BBB suddenly sided with the landlords and made it clear that party leader Caroline van der Plas now also supports that course. According to BBB, home owners should be able to decide for themselves whether they want to rent their homes with a permanent or a temporary contract.

The CDA also took an extremely critical position and did not want to indicate at the end of the debate whether it supported the initiative law. The group will deliberate further. At the moment, only support from GroenLinks/PvdA, ChristenUnie, PVV, SP, Volt, Party for the Animals and D66 is certain. Together these parties account for 34 of the 75 seats.

Protection

The CDA, which has 6 seats in the Senate, can therefore help the law gain a majority. If it follows its own Minister of the Interior Hugo de Jonge, that will happen. The outgoing minister was initially against the law, but still supported it because he believes good protection of tenants is important. The vote will take place next Tuesday and it will then become clear whether temporary rental contracts will be banned.

If that is the case, it only applies to new contracts. Exceptions also remain possible, which Minister De Jonge will include in the order in council.
