Italian Court Rules in Favor of Mother, Evicts Sons in their 40s

(CNN) A local court in the northern Italian city of Pavia recently ruled in favor of a 75-year-old mother who was suing to evict her two sons, both of whom are in their 40s, who live in her home.

This was revealed by a court clerk who responded to an interview with CNN. In her complaint, her mother criticized her two sons, ages 40 and 42, as “parasites” who continue to stay in the apartment without paying for living expenses or helping with housework. Two people had jobs.

The mother was retired and separated from her son’s father. Most of her own pension was used to pay for the maintenance and management of her home and food.

In his ruling, the judge equated the two children with big babies and ordered them to leave their mother’s home until December 18 this year. He also concluded that “there is no law that allows an adult child to remain in a house owned only by his parents, against his parents’ will, with unconditional rights.”

According to local newspapers, the son hired a lawyer to resist his mother’s eviction order. “Parents in Italy are required by law to take care of their sons for as long as they need,” he said.

In this case, the judge acknowledged that there is a law regarding parents’ obligation to provide support, but pointed out that the application of this law could no longer be justified given that the two sons were over 40 years old. He also admonished, “Children cannot expect their parents to support them beyond what is reasonable.”

A lawyer for the son told local media that he had not decided whether to appeal.

In Italy, there have been court cases in the past involving adult men who were too dependent on their mothers.

According to 2022 data from the European Union Statistics Office, the average age of Italians leaving their parents’ home is 30. Croatia had the highest rate of 33.4 in the EU. Conversely, in the Nordic countries of Finland, Sweden and Denmark, the average age was 21.
