Noticeably, there are voices that say that the crisis is going far. Maybe too far. And they add, no one wants to give in, or everyone must give in. The purpose is correct because every process like the current one demands that the parties give in at some point. Now, in our case, the first thing that needs to be identified are the reasons why there is a crisis with the magnitude of the current one. The first thing that must be put on the table is that the origin of the entire crisis we are experiencing is the refusal of the traditional power groups that have refused, since they knew the electoral results, to recognize the victory at the polls of Bernardo Arévalo and his Seed match.
From that fact onwards, the apparently legal nonsense of a clique entrenched in the MP and, unfortunately for us, in the high courts began. The Supreme Court of Justice, for the usurpation for more than 3 or 4 years of positions that the current magistrates should have been relieved of. It is the same with the Constitutional Court that forgot its function of being guarantor of the constitution, violated time and again by themselves and other actors of what we call the corrupt pact.
In all the anomalies observed in the courts and their behavior, the frivolity of the members of Congress stands out. Nobody forgets that the CSJ was negotiated by the PP and Líder, that is, by Sinibaldi and Baldizon, and of which we know with all the impudence in the world, that it was around a hotel bed!!!
Something similar happened with the CC. All products of negotiations between political parties and not from the exercise of a career as jurists that put suitability, professionalism, real academic instincts, and the exercise of the profession in an outstanding manner first. On the contrary, it is the arrangements in the dark, under the table, or around a bed that have prevailed.
As we see, the origin of everything is very clear. And the truth of everything is that it was built with patience, in view of everyone, during the last years. And for what? Well, to continue with the usufruct of power, for dirty businesses or for elemental impunity. As simple as that.
So much was the pitcher to the water.
As a result of everything mentioned above, there are social mobilizations in the entire country and internationally. We see activities in Mexico, Spain, the United States and other countries, but, above all, in the indigenous communities of Guatemala, in the markets, in the universities, in the workers’ sectors, which demand that our country be capable of returning to democratic causes. , violated by the institutions that should be responsible for ensuring the existence of a democratic state of law.
But this return has as a precondition that the people identified by society in large numbers and with expressions in all sectors, resign. And then you can discuss the different aspects of democracy that is about to be collapsed by the action of small illegal minorities.
Currently the justice system is at the lowest point of credibility and legitimacy that could be imagined. The perversion of the country’s laws is such that criminal or penal investigation is not believed because, from ordinary citizens, it is considered that it is carried out by criminals. And with the CSJ the joke tells itself. And with this situation, they insist in an intemperate chorus, on promoting lawfare to the chapina, to the tortrix, well. But in our case, with absurd calls for repressive violence. And we cannot allow that.
It is the twisting of the law, the use of institutions that should be impartial, partly a conspiracy to ignore democracy, it is, in short, the idea that those who won the elections should not be anointed as the new government, but rather have They have to be reviled by all means, including those that reveal from afar their spurious quality.
It is now necessary to establish whether the democratic maturity of the National Civil Police, with origins in the Peace Accords and the army converted to respect for democratic life, have the height to refuse to execute illegal, spurious and clearly coup-oriented orders. Which would be done in respect of the constitution and the right to civil disobedience in the face of clearly unconstitutional as well as illegal orders. This is something that is expressly established in Article 45 of the Constitution and Article 21 of the Transitional Constitution. Well, we cannot expect anything from the CC and the CSJ, much less the MP. All these institutions have already exceeded the limits of sanity and the democratic nature found in their constitution.
