Ultra-Violent Burglary at Gevrey Wine Grower: Verdict and Sentencing of Accused – Maxime Bigot, Andy Simonot, and Loïc Dameron

Since Monday, Maxime Bigot, Andy Simonot and Loïc Dameron, accused of the ultra-violent burglary at a wine grower in Gevrey, in May 2019, have appeared before the Dijon Assize Court. The verdict fell this Thursday evening.

“He did not die from the blows, but he no longer has life”, summarizes the president of the barrister Brultet, in his pleading as a civil party, about Bertrand, the wine grower from Gevrey who was seriously disabled after his attack in May 2019 during a burglary. Violence perpetrated “by Andy Simonot and Maxime Bigot”, maintains attorney general Christophe Aubertin, “under the watchful eye of Loïc Dameron, passive in the violence but very active in armed robbery”. A theft “of nothing at all, a villainous motive” which makes the crime “heinous”.

In sharing responsibilities, the attorney general asks the jurors: “Should we count the blows given by one or the other? No, because both were present, both participated in the violence.” He makes a distinction between Maxime Bigot, older, with a heavy record, and “who takes no responsibility for anything” and Andy Simonot, 18 years old at the time of the facts, with a clean record, and “more honest”. On the other hand, for the latter, he rules out the alteration of discernment. He proposes 15 years of imprisonment for the first, 13 for the second, and 6 years against Loïc Dameron.

In a short and brilliant pleading, Me Bruno Nicolle strives to make the jurors understand how his client, a young man from a good family, fell into the “mess” that would lead him to the victim’s bedroom. An attention disorder with hyperactivity, diagnosed late, leads to his being sidelined, with toxic substances as a way out. The young man is now fully integrated and for Mr. Nicolle, sending him back to prison makes no sense.

A “delirious whiff? »

Me Marine Berthelon took over for Andy Simonot, pleading energetically on the personality of her client, now diagnosed with schizophrenia. Diagnosis not made at the time of the events, “but he was already ill”, she assures. “He drank to calm the voices he heard in his head. » For the lawyer, her behavior on the evening of the events had everything of a “delusional outburst”. President Touraille recounted with deep emotion the life of Andy Simonot, “a marathon of suffering”. “The events took place seven years after his mother abandoned him, in May. And when he enters this room, where the victim, who is an alcoholic, lives, he is thrown back into his childhood, causing the explosion of violence. »

Me Aurélie Champenois chooses another angle for the defense of Maxime Bigot, by taking up “the only objective elements of the case” to demonstrate that her client’s participation in the violence could have been limited to the two blows that he admitted to. “These objective elements should prevent you from being overwhelmed by feelings, hypotheses and conjectures,” she concludes.

The Court sentences Loïc Dameron to 5 years in prison, including 18 months suspended, Andy Simonot to 10 years’ imprisonment, the alteration being retained, and Maxime Bigot to 14 years’ imprisonment.
