The maximum sanction can go as far as permanent exclusion of the student. The Ministry of Education reminds in a press release that it is “the role of the school to recall that certain comments (calls to hatred, racism and anti-Semitism, apology for terrorism) constitute a criminal offense, without entering into discussion controversy with the students concerned.
The Légifrance website explains that the sanctions can gradually go from a warning to a reprimand, to a measure of accountability, to temporary exclusion not exceeding eight days, and finally to definitive exclusion from the establishment or one of its ancillary services . Apart from this last maximum sanction, “sanctions are erased from the student’s administrative file at the end of their secondary education”.
Article 421-2-5 of the Penal Code stipulates that advocating terrorism can be punished by up to 5 years of imprisonment and a fine of 75,000 euros.
Hundreds of incidents in 2020
Three years ago, history professor Samuel Paty was assassinated in Yvelines. During the tributes paid to him, 793 incidents were reported in the form of provocations, protests and apologies for terrorism. As recalled Le Figaro44 definitive exclusions had been pronounced and 131 temporary exclusions, when 286 reports had been made to the police or the gendarmerie (and 136 to the public prosecutor’s office).
