The Constitutional Court Grants Lawsuit of Surakarta University Students Regarding Age of Presidential Candidates

The Constitutional Court (MK) granted the lawsuit of Surakarta University (Unsa) students regarding the age of presidential and vice-presidential candidates remaining at 40 years unless they have experience as regional heads. Responding to the Constitutional Court’s decision, the online motorcycle taxi community in Subang bowed down in gratitude.

This activity was carried out by the Subang online motorcycle taxi community, prostrating gratitude at Taman Lampu Merah Soklat, Pasirkareumbi. They are grateful for the Constitutional Court’s decision which allows young regional heads to run as presidential or vice presidential candidates.

“Thank you for the Constitutional Court’s decision to decide that young leaders can run as presidential or vice presidential candidates,” said action coordinator Sri Wahyono in a written statement, Monday (16/10/2023).

This community supports the Mayor of Solo, Gibran Rakabuming, to run for the 2024 presidential election. They want Gibran to appear on the national political stage.

“We hope that Mas Gibran can become a trustworthy leader and are ready to support Mas Gibran to advance as a leader at the national level,” he said.

It is known that the Constitutional Court granted a judicial review of Law Number 7 of 2017 concerning General Elections regarding the age limit for presidential and vice presidential candidates proposed by an Unsa student named Almas Tsaqibbirru Re A. Almas. The Constitutional Court stated that the age limit for presidential and vice presidential candidates remains 40 years unless they have experience as regional heads.

“Granted the applicant’s request in part,” said Chief Constitutional Court Anwar Usman.

He said this at the hearing at the Constitutional Court Building, Jalan Medan Merdeka Barat, Gambir, Central Jakarta. In his considerations, Anwar stated that previous requests such as the Garuda Party were different from the request submitted by this UNS student, namely in the norms of the articles requested.

“Regarding the petition petitum in the cases referred to, it can be said to contain an ‘ambiguous’ meaning due to the nature of the position as a state administrator, the procedure for obtaining it can be done by being appointed/appointed or elected in a general election,” he explained.

He explained that this was different from what was expressly requested in the petitum of the a quo petition, where the applicant invoked the provisions of the norms of Article 169 letter q of Law Number 7 of 2017 to be interpreted as ‘Being at least 40 years old or having experience as a regional head at both provincial and district levels/ city’.

In order to realize the participation of qualified and experienced candidates, the Court considers that experienced state officials as members of the DPR, members of the DPR, members of the DPRD, Governors, Regents and Mayors are suitable to participate in the national leadership contestation in casu as presidential candidates and candidates Vice President in the election even though he is under 40 years old.
