On September 21, 2023, several associations, including the National Tree Surveillance Group (of which opponent Thomas Brail is a member) and two private companies filed a request for interim suspension before the administrative court of Toulouse. The subject of this emergency procedure: the A69, the new motorway link between Toulouse and Castres. This time, the appeal challenges the legality of the decree of March 1, 2023 relating to environmental authorizationfocusing on the felling of roadside trees as part of the project in order to stop the work.
The hearing took place on October 6, 2023, in the morning. The decision rendered in the afternoon. The Toulouse administrative court once again rejected this appeal, finding that the file did not allow “creating serious doubt about the legality” of the decree. The work will therefore continue. The legal battle is not yet over, however, since the administrative court is still seized of an appeal on the merits, filed in June 2023, against the decree of March 1, 2023. A longer procedure, which does not prevent however, the continuation of the construction site.
