Previously, the Police Investigation Agency of Dinh Quan District Police (Dong Nai Province) decided to prosecute the case and criminally detain Hoang Van Tinh (37 years old) to investigate the “Violation of regulations on road traffic participation”.

The investigation agency determined that the cause of the above particularly serious traffic accident was that driver Tinh veered left on Highway 20 and then crashed head-on into a 16-seat car traveling in the opposite direction.

Meanwhile, a representative of Road Management Area 4 (Vietnam Road Department, Ministry of Transport) said that in the area where the accident occurred between Thanh Buoi’s car and a 16-seat passenger bus, the maximum speed was 50km/hour. h because of dense population.

Through checking the trip monitoring device, Thanh Buoi’s car was traveling at a speed of 69km/h at the time of collision, exceeding the regulations, not keeping a safe distance, then swerving across the lane, swiping into the rear of the truck, encroaching on the next lane leading to the collision. to collide with a vehicle traveling in the opposite direction.

Face the highest penalty for violating traffic regulations

From initial information, the incident showed signs of a crime, so the criminal detention agency prosecuted the Thanh Buoi bus driver who caused the accident to serve the investigation and carry out legal proceedings. is in accordance with the law, in accordance with the order and procedures.

According to lawyer Khuyen, in this case, the investigation agency will examine the scene, perform an autopsy, extract camera data from the scene area, collect statements from witnesses… to determine the cause of the incident. The collision resulted in 5 deaths and many others being injured.

In case there is enough evidence to determine that the driver of the Thanh Buoi bus is partially or completely at fault due to lack of observation, speeding, use of stimulants, or improper driving license. … then this driver will be prosecuted for criminal liability for violating regulations on road traffic according to Article 260 of the 2015 Penal Code.

If proven guilty, with the result that 5 people died, the bus driver could face the maximum penalty for violating road traffic regulations of 7 to 15 years in prison. . This is the highest penalty for this crime.

In addition, the driver must also fulfill the obligation to compensate the victims’ families according to the provisions of Article 591 of the 2015 Civil Code, the compensation includes reasonable expenses for burial and alimony. for those to whom the injured person is obliged to provide support and other damages prescribed by law.
