France’s Position on the Legal Proceedings of Vanessa Mendoza Cortès, President of “Stop Violence” Association in Andorra

Ms. Mendoza Cortès spoke in 2029 during a session organized by the United Nations Committee on the Elimination of Discrimination Against Women (CEDAW). She recalled and criticized the worrying situation of reproductive and sexual rights in her country where abortion is completely prohibited. She is now charged with a crime “against the prestige of institutions” (article 325 of the penal code) and faces a maximum fine of 30,000 euros as well as an entry on his criminal record. The purpose of this type of international meeting is precisely to discuss the respective national situations of the participating countries with the aim of advancing national legislation and international law.

It is therefore inconceivable that Ms. Mendoza Cortès would be prosecuted for having revealed the situation regarding abortion in Andorra. Mr. Emmanuel Macron, as President of the French Republic, is co-prince of Andorra.

France’s international strategy on sexual and reproductive rights and health adopted for 2023 places access to safe abortion as one of its priority themes. The latter emphasizes in particular that France wishes to carry out ambitious political advocacy in all international, multilateral and bilateral spaces, in order to guarantee the rights to control one’s body and sexual and reproductive health as an essential condition for equality between women and men”.

While the right to abortion is under attack in several parts of the world, while France faces a shortage of miprostol – necessary for medical abortions – and that a bill to constitutionalize the right to abortion was adopted by the National Assembly in October 2022, it seems relevant that an official position of France be taken in favor of Mrs. Mendoza Cortés; she asks him his position on this subject.”
