A very simple mistake in the cancellation policy required in Tesla purchase contracts is currently costing Tesla a lot of money.
Tesla does not sell its vehicles through a dealer network or branches, but mainly online or by telephone and must therefore grant consumers a right of withdrawal in the purchase contracts. In the cancellation policy, the buyer must be able to identify where and how he can exercise his cancellation and the seller must provide the name, address, telephone number and email address at which the cancellation can be made.
Tesla forgot to provide the telephone number in the cancellation policy of the purchase contracts.
This gives Tesla buyers the opportunity, under certain conditions, to return the vehicle and receive the full purchase price back, without any deductions for kilometers driven. (Judgment of the LG Berlin dated June 16, 2023; Ref. 38O111/23)
How and when does this work?
You must have purchased the vehicle directly from Tesla as a private individual (i.e. consumer) and not as a company car.Purchase must be before April 2023! Because then Tesla corrected the purchase contracts.You must have received the vehicle within the last 12 months and 14 days! The purchase contract must contain a cancellation policy in which the telephone number is missing.
Given the very high loss in value of used Tesla vehicles, it can be economically interesting to have a specialist lawyer check whether you could actually drive your new Tesla free of charge for 12 months and 14 days and then return the vehicle to Tesla for a full refund of the purchase price.
