A series of meetings was held this week at Le Pavé Antaninarenina, for the preparation of legislation on bioenergy, which shows strong development potential.
The bioenergy sector is among the most promising sectors, given the environmental context and concerns about energy production in Madagascar. Faced with this situation, the Ministry of Energy and Hydrocarbons (MEH) initiated the creation of a draft law on bioenergy in partnership with key players in the sector. During a series of meetings held from September 12 to 14, 2023 at Le Pavé Antaninarenina, this ministerial department, in collaboration with WWF and UNIDO, worked on the preparation of this crucial legislation. The three-day workshop, entitled “Consultation and validation of the draft law on Bioenergy in Madagascar”, brought together stakeholders representing various aspects of the bioenergy sector. During these discussions, significant improvements and modifications were made to the original draft law, including additions deemed relevant. A consensus was reached on the general rules that will govern the various activities linked to bioenergy in Madagascar. This includes clarifying requirements for all stakeholders regarding the grant conditions, procedures and benefits linked to the legal regimes to which all players in the bioenergy sector will be subject.
Responsibilities
General principles have also been adopted to guarantee the safety of operators’ installations and operations, encourage private investment in the sector and facilitate environmental protection. A crucial step in these discussions was the clear definition of the missions, roles and responsibilities of the various stakeholders, in particular the ministries, the bioenergy regulatory body, the Malagasy Hydrocarbons Office (OMH), the National Office standards (BNM), the National Environment Office (ONE), etc. This clarification aims to avoid conflicts of jurisdiction and ensure effective implementation of the legislation. In addition, new provisions and areas that fall outside the scope of the law have been identified and will be included in subsequent regulatory texts. In short, the bioenergy bill developed thanks to the will and active participation of all stakeholders will be presented to the government and submitted to the votes of the two Parliaments during their next session. This initiative marks a significant step towards the sustainable development of bioenergy in Madagascar, providing a solid legal framework to govern the growing sector.
