What is the law that comes into force on September 13 about?
Starting this Wednesday, September 13, background checks will be required for buyers of antique firearms and ammunition in New York State. Legislation requiring New York State to conduct background checks for both firearms and ammunition transfers requires a fee to be charged for each transaction. The $9 gun background transaction fee and the $2.50 ammunition background transaction fee will be used to fund the New York State background check system.
What are the strictest gun safety laws in New York State?
Legislation that strengthened New York’s gun permit process and provided a national model for gun safety and combating gun violence went into effect on September 1, 2022, and included requirements for comprehensive gun checks. background and gun safety and live-fire training for people seeking to obtain concealed carry permits; prohibited concealed carry permit holders from carrying their firearms into sensitive locations, such as schools, government buildings, and hospitals, among others; and required renewal or recertification of permits every three years. The state He also launched a website at that time on firearms safety to provide the public, gun owners and dealers with complete information about the new state law requirements.
New York also standardized and strengthened background checks for concealed carry permits by requiring four-character references; a list of previous and current social media accounts from the last three years; disclosure to the applicant’s spouse or common-law partner, any other adult residing in the applicant’s household, including the applicant’s adult children; and an in-person interview with your licensing officer or designee. Under the law, licensing officials may request any additional information they deem appropriate.
All applicants for a concealed carry permit who applied on or after September 1, 2022 must take a firearms safety training course that includes a 16-hour in-person component and real firearms safety training of two hours. People who live in New York City and Nassau, Suffolk and Westchester counties must renew their permits and complete training.
The training is designed to provide licensed firearms owners with the skills and knowledge necessary to safely store and carry their firearms, and educate them on other topics, including conflict reduction, suicide prevention, and use of deadly force, which will help them keep themselves and others safe.
Additionally, concealed carry permits are now required to renew and recertify every three years instead of five. Can Find information about the online recertification process for permit holders here.
In 2022, Governor Hochul also announced new permit and minimum age requirements related to ownership of semi-automatic rifles that went into effect on September 4 of that year. A person must now be at least 21 years old and have a permit before purchasing or taking possession of a semi-automatic rifle. These new requirements were included in a package of legislation signed by the governor in response to racially motivated mass shootings and murders in Buffalo in May 2022.
The State Police and the state Division of Criminal Justice Services also developed Frequent questions about new gun laws for the public, gun owners and dealers. In addition to training and expanded background check requirements, the laws also:
People were restricted from carrying their pistol or revolver hidden in sensitive places. Persons who are not exempt from this restriction under the law can be charged with a felony for violating its sensitive locations provision; Monthly checks of permit holders are required to determine if they have criminal convictions or court orders that would disqualify them from holding concealed carry permits; Required that firearms in unattended vehicles be unloaded and stored in a fire-, impact-, and tamper-resistant storage bin that is hidden from view; and Secure storage requirements were expanded if children under 18 or anyone prohibited from owning a gun live in a home with firearms, rifles and shotguns.
Additionally, effective September 1, 2022, any ammunition seller or firearms dealer must maintain an electronic record, data set, or organized collection of structured information or data, generally stored electronically in a computer system. The record must be entered at the time of each transaction involving ammunition and include the date, name, age, occupation and residence of any person from whom the ammunition is received or to whom the ammunition is delivered, and the quantity, caliber, name of the manufacturer and serial number or, failing that, any other distinctive number or identification mark of the ammunition.
How the new laws have changed the numbers in New York
The governor noted in September that since the implementation of this new law to protect New Yorkers from gun violence or any other form of harm, shootings have decreased by approximately 26 percent statewide in the last year. CDC data shows New York has the fourth-lowest gun death rate in the country, and because of the impact of conceal and carry laws, the Democrat said New York continues to lead the way in further implementing common sense gun safety legislation that prevents harm to people and communities.
