Empty plots illegally allocated to arrondissement 3: Omer, Kouessé and Giscard D’Estaing still remain in prison

An extraordinary hearing of the Bobo-Dioulasso ECOFI cluster was held on Friday August 25, 2023 in the courtroom of the High Court. The case of the day involved three people in a case of plots.

They are Omer Sanou, estate agent, Kouessé Sanou, receiver of estates and Giscard D’Estaing Sanou, all from district 3 of the municipality of Bobo-Dioulasso. They are prosecuted and placed under a warrant of committal on June 12, 2023 by the prosecution of the Tribunal de Grande Instance of Bobo-Dioulasso. They are charged with offenses of abuse of office, forgery and use of forgery in public writing, and complicity. The three individuals would have organized themselves into a network to commit these acts. In their plan, it is the named Giscard D’Estaing who circulated in various sectors of the city of Bobo-Dioulasso, in particular in sector 31, to identify empty plots. Kouessé Sanou, he was the respondent of the network at the domain level responsible for facilitating the acts. After this phase, they use maneuvers to illegally allocate said plots. To do this, they establish false documents with the complicity of the state agent Omer Sanou. Once the documents have been drawn up, they develop the land concerned by building on it. In fact, it emerged that a total of 14 plots were identified and illegally allocated.

At the helm on Friday August 25, 2023, the prosecution requested that the file be sent back to seize an investigating judge in view of the complexity of the facts. Defense attorneys are not opposed to this request. Instead, they pleaded for the provisional release of their clients. For advice, their clients have been detained since June 12 and have still not been tried to date August 25, 2023. They have been in detention for more than two months. In view of this, the lawyers demand that their clients be released. Another argument put forward by counsel. ” Our clients are all fathers of families. The start of the school year is approaching while these children are counting on them to be educated”, say the lawyers.

The prosecution opposed the provisional release of the three defendants. But, the correctional court ended up ordering the provisional release in favor of the three defendants and returned the file to the table of the prosecution for the purpose of seizing an examining magistrate. But their provisional release will be short-lived, as the prosecution immediately appealed this decision. For the moment, the three defendants are kept in prison pending the end of the investigation.
