The Importance of Rehabilitation for Businessman Hisham Talaat Mustafa in the Suzanne Tamim Murder Case

Several questions were imposed by the ruling of the Cairo Criminal Court today, Sunday, regarding the rehabilitation of businessman Hisham Talaat Mustafa in the case of the murder of the Lebanese singer Suzanne Tamim.

On top of the questions; What does rehabilitation mean and what is its importance for the Egyptian real estate tycoon who was granted a presidential pardon in 2017.

Court of Cassation, Ashraf Nagy, says that the request for “rehabilitation” is available to anyone who has been convicted of a felony or misdemeanour, and it is issued by the same court to which the convict’s place of residence belongs, provided that 6 years have passed since the execution of the sentence or a pardon is issued.

In the case of Hisham Talaat Mustafa, 6 years have passed since he was pardoned for the remainder of his sentence in the case of the murder of the Lebanese singer Suzanne Tamim, as the Court of Cassation convicted him of 15 years in prison for participating in and instigating the murder of the singer in Dubai in 2008.

Regarding the importance of “rehabilitation,” the legal expert explained that the person regains his basic rights, “the case has been erased from its history and it has become completely without a criminal record.”

Article 552 of the Code of Criminal Procedure stipulates that “rehabilitation entails the erasure of the conviction sentence for the future (convict) and the disappearance of all that entails incapacity, deprivation of rights and all other criminal effects.”

“Naji” gives examples of the rights that a person who has been rehabilitated can recover, “the right to run for parliamentary councils – club administrations – obtaining a government job” and other rights that require “a person not to obtain a judgment in a crime” and also state that he is of good conduct and behavior.

He points out the importance of “rehabilitation” for the convicts, as it prevented the Brotherhood leader, Khairat Al-Shater, from running in the presidential elections in 2012, and he was excluded despite obtaining a presidential pardon, but he did not obtain a rehabilitation. “The presidential pardon is for the rest of the sentence, but rehabilitation erases the crime from log”.

It is noteworthy that businessman Hisham Talaat Mostafa obtained a presidential pardon after being convicted of the murder of the Lebanese singer Suzanne Tamim, by instigating former officer Mohsen al-Sukkari – who came out with a presidential pardon – to kill her in Dubai in 2008 for $2 million.
