Freiburg Climate Camp vs. Christmas Market: Legal Dispute over Town Hall Square

Freiburg (dpa / lsw) – The Freiburg climate camp on the town hall square should shrink according to the will of the city and even make room for the Christmas market. The municipality is preparing for a legal dispute: “Now we will do what is necessary and, if necessary, have the matter clarified in court,” said Mayor Martin Horn (independent) on Wednesday. The city had previously issued two decrees to the climate camp. The activists had already announced that they might take the dispute to the local administrative court.

According to the information, one of the decrees states that the four tents must be temporarily dismantled so that the Christmas market can take place on the square as usual. Under the second injunction, two of the four tents must be permanently removed. So they shouldn’t be set up again after the Christmas market.

“Our town hall square belongs to all Freiburg residents, but it does not belong to tents that have been mostly empty for months,” explained Horn. “We would have liked to have solved the issue without a legal dispute and therefore held many discussions and made fair offers.” It was disappointing that there was no concession from the climate camp. It’s about proportionality and fairness, said the OB. “We as a city cannot be blackmailed.”

The Black Forest metropolis with more than 230,000 inhabitants describes itself as “Green City” (“Green City”) and had offered the camp, which is present day and night with tents, two alternative locations for the duration of the Christmas market. The climate camp rejected this, among other things, due to security concerns. The camp had been set up just over a year ago. The Christmas market has existed since 1973.
