The case with the changes in the Penal Code related to confiscating cars from drunk or drugged drivers turns out to be more complicated than an intimate relationship.
The cars of drivers caught with more than 1.2 percent of alcohol or after the use of drugs should be confiscated for the benefit of the state. However, if the vehicle is not in our name – the owner must pay the market value of the vehicle. This is foreseen by the changes in the Criminal Code, which came into force at the beginning of the month.
“The paragraph on the basis of which motor vehicles are confiscated is actually read incorrectly, because the court is the authority that can determine the confiscation of immovable property, not the police or the prosecutor’s office,” explained the teacher of constitutional law Assoc. Nataliya Kiselova.
Dozens of cars have already been confiscated across the country. They are stored in the respective police departments where the violation was established. However, this can turn out to be an expensive undertaking, and those who do not even have cars and licenses will pay for it.
“There are very expensive cars that may disappear. This will be the subject of lawsuits that the person will win and we will pay from our taxes,” commented traffic accident lawyer Elitsa Buenova.
The changes were adopted en masse and without debate at the last extraordinary session of Parliament, along with changes to the Domestic Violence Act and the concept of an intimate relationship, informed Bulgaria On Air.
“There is an option where these cars will be stored, we are currently in close communication with the prosecutor’s office, where we are considering how and in what way such cases will be worked on, where these cars will be stored, who will guard them, but I believe that this is a very good measure”, said the Minister of Internal Affairs Kalin Georgiev.
