Libreville, Thursday August 10, 2023 (Gabon Info) – This civil society movement seized the Constitutional Court with a view to the repeal of this voting document.
During a press conference given on Wednesday in Libreville, the Citizen Copil, a Gabonese civil society organization, announced that it had seized the Constitutional Court with a view to the cancellation of the single ballot for the general elections of August 26. . “We have the honor to submit to Your High Court an appeal for the annulment of certain provisions of the decree cited in the subject, which decree violates articles 2, 4 and 5 of our as well as certain provisions of law no. 07/96 of March 12, 1996 laying down common provisions for all political elections, all of the subsequent texts”, underlines an extract from the referral to the Citizen Copil, read to the press by Geoffroy Foumboula Libeka Makosso.
In its request, Citizen Copil denounces a violation of the provisions contained in Articles 2, 4 and 5 of the Constitution relating to the separation of powers and the exercise of national sovereignty by the people. In particular, Articles 3 and 5 of the Constitution of the Fundamental Law which provide that: “The Gabonese Republic is organized according to the principles of national sovereignty, the separation of executive, legislative and judicial powers and that of the rule of law “.
At the level of Articles 34 and 79 of the electoral law, the applicants also denounce a violation of the principle of voting by electoral constituencies. By referring to article 2 relating to a single ballot for the uninominal ballots of the presidential election and the legislative elections. “Article 2 of the disputed decree presenting a single ballot paper for two elections, while the constituency of the Diaspora must only house the vote of a single (presidential) election, therefore not having in a polling station that the ballot papers related only to the presidential election and no other election, it is appropriate to cancel this decree”, underlines Copil citizen.
