Date: August 8, 2023
Location: Koh Phangan, Thailand
Daniel Sancho, a Spanish national, has been placed in pretrial detention in Thailand after being accused of the premeditated murder of surgeon Edwin Arrieta. Sancho's Thai lawyer arrived at Koh Samui prison on Tuesday to visit his client for the first time since the court ordered his detention.
Sancho's lawyer stated that his client is "relaxed" and aware of the charges against him. The lawyer expressed confidence in resolving the case quickly. Sancho had pleaded guilty before the judge, who denied his request for bail. Following a reconstruction of the crime on Koh Phangan island, Sancho was transferred to the neighboring island's prison, a 40-minute ferry ride away.
Sancho will spend the next 10 days in isolation, following Covid protocols in the Thai prison system. During this time, he will only be allowed visits from his family's hired lawyer.

Daniel Sancho, a 29-year-old Spanish national, has been placed in pretrial detention in Koh Samui prison, located in southeastern Thailand. Sancho is facing charges of premeditated murder in the alleged killing of 44-year-old surgeon Edwin Arrieta. His Thai lawyer, Khun Anan, visited him for the first time on Tuesday, stating that Sancho is "relaxed" and aware of the charges against him.
During the court hearing, Sancho pleaded guilty, but his request for bail was denied. Following the reconstruction of the crime on Koh Phangan island, Sancho was transferred to the neighboring island's prison, a 40-minute ferry ride away. He will spend the next 10 days in isolation, adhering to the Covid protocols implemented in the Thai prison system. Only his family-appointed lawyer will be allowed to visit him during this time.
The slow pace of the Thai justice system is a cause for concern for Sancho's family, as the sentencing process can take months or even up to a year. Thailand's penal code includes the death penalty for cases of homicide, although it is often commuted to life imprisonment. In some instances, the convicted individual may receive a prison sentence ranging from 15 to 20 years.
Sancho's defense strategy will likely involve seeking extradition, although this process is complicated due to the limited number of bilateral agreements Thailand has regarding extradition. Unfortunately, Spain is not among the countries with such an agreement.
If convicted, Sancho will likely be transferred to Klong Prem prison in Bangkok, where he would join four other Spanish inmates. Notably, among them is Artur Segarra, who was initially sentenced to death (later commuted to life imprisonment) for the premeditated murder and dismemberment of fellow Spaniard David Bernat in 2016.
Klong Prem is a severely overcrowded maximum-security prison housing over 6,000 inmates, with the majority serving sentences related to drug offenses. The latest figures for Koh Samui prison, also facing overcrowding issues, indicate that it houses nearly 700 prisoners, including 14 foreigners.
Sancho's family remains hopeful for a swift resolution to the case and has expressed their willingness to cooperate fully with the legal process.
