Promoting Objective Liability Lawsuits: Holding Public Service Institutions Accountable

The Barra Mexicana Colegio de Abogados urges citizens to promote Objective Liability lawsuits against public service institutions that do badly or do not do the activities for which they were created, such as from poor healing to the breakdown of a car for some bump “We have to venture into the field of legality”as stated by the lawyer Francisco Javier Betancourt Solís.

The president of the Barra Mexicana Colegio de Abogados AC., stressed that the bar he is in charge of is not against any official or employee of the state, federal or municipal government, it simply seeks that citizens assert their rights and that officials do your homework well.

He said that the citizen has in his favor that of Objective Responsibility of the State, with which he can make his rights before the Administrative Court which, according to the defense that the citizen has, may be granted the right to have the damage repaired for an omission or action of any public institution.

He stressed that the authorities of the federal, state and municipal governments present many omissions that have to be pointed out through the lawsuits, since most of the times they are pointed out but nobody pays attention until they receive the request from the judge.

The litigant cited the most common case, which is potholes and that since these potholes do not have an indication that this pothole exists, the municipal authority has the responsibility of responding to the citizen for the damage that pothole has caused to the citizen’s patrimony.

Or the case may arise in hospitals that instead of operating on the right hand I operate on the left, or due to the lack of doctors or nurses, greater complications arise in the patient’s health.

There are many cases of responsibilities that the authorities have, however, in order to achieve that the judge of the Administrative Court can establish responsibility, evidence will have to be presented and for this it is necessary that they have the support of a lawyer.

We have to enter the culture of legality, the culture of the authorities doing well the job for which they were designated and one way to do it is through the State’s Objective Responsibility trial.
