The YouTube channel ‘Garosero Research Institute (Ka Se-yeon)’ won part of the appeal trial against Musical Company A, which co-produced ‘Musical Park Jeong-hee’.
According to the legal community on the 23rd, the 4th Civil Division of the Seoul High Court (Presiding Judge Lee Kwang-man) overturned the first trial, which ruled against the plaintiff in a lawsuit filed by Ka Se-yeon asking for damages from Musical Company A, and ruled that “the plaintiff must be compensated 60 million won.” The CEO of Musical Company A is Kim Jae-cheol, former president of MBC.
Ka Se-yeon and Musical Company A signed a contract in 2020 to co-produce and perform the musical “Park Chung-hee,” which deals with the life of former President Park Chung-hee, and distribute profits. Ka Se-yeon paid about 440 million won to the production company for the production of the musical, and the production company conducted 20 performances. Ka Se-yeon later delivered 50 million won in the process of negotiating additional performances, but the performance was not held due to problems such as an increase in production costs.
Ka Se-yeon filed a lawsuit against Musical Company A, claiming that Musical Company A unilaterally stopped additional performances, causing damages, and demanding compensation for about 300 million won in ticket refunds. The first trial judged that the plaintiff lost, saying that a formal contract for additional performances had not been signed.
The second trial, however, acknowledged the liability for compensation for the additional preliminary claim of 60 million won, which was added while appealing by the Gaseyeon side. The second trial court ruled that the production company should pay the 50 million won that Ka Se-yeon remitted on the premise of an additional performance and the 10 million won that were not settled at the time of the premiere.
