The northern Italian city of Padua has started removing the names of non-biological mothers from their children’s birth certificates. This happens in response to new legislation from the right-wing government of Prime Minister Giorgia Meloni.
These are initially birth certificates of 33 children of Italian women who underwent artificial insemination abroad and subsequently registered their children with the municipality in 2017. The Padua Prosecutor’s Office confirmed to CNN that on Thursday the names of 27 mothers were removed from as many birth certificates.
The Padua city council had promised to expand the traditional mentions of mother and father on birth certificates. In this way, non-biological mothers in family situations in which two women have a child together could also be added.
This decision was reversed when Meloni’s government ordered local authorities to stop registering both names of same-sex parents. The measure also applies to male couples who have children. They also have to choose who is listed as the father on the birth certificate.
From now on, only a biological parent of a child may appear on the birth certificate. The new legislation thus restricts the rights of the non-biological parent. From now on, this parent must be given permission to carry out family tasks such as picking up the children from school.
LGBTI marriage is not legalized in Italy. Because same-sex relationships are not legally recognized, after the birth of the child, the non-biological parent must take the legal path necessary to adopt the child.
Surrogacy is also illegal in Italy. Meloni, who believes that ‘all children should be born of one man and one woman’, wants to restrict surrogacy even further through a new bill by making it a criminal offense for Italians to have children through a foreign surrogate mother. This restriction, which has not yet been debated in parliament, would apply to both heterosexual and LGBTI couples.
