Court Delays Ruling in Mario Iorgulescu Trial

Iorgulescu’s lawyers request the hearing of all the witnesses heard by the trial court, as well as the completion of a new forensic expertise. Among the requests of the lawyers is the hearing of three witnesses rejected by the trial court. But also a new medico-legal expertise, which will show the blood alcohol level of the defendant.

The court will decide on each individual request.

The meeting continues with the analysis of requests for evidence, including the one aimed at suspending the criminal process.

It stipulates emergency admission and intensive psychiatric treatment, after Iorgulescu jr ran away from the clinic and was forcibly admitted with the help of the carabinieri.

The file reached the Bucharest Court of Appeal (CAB), where the court, according to the law, should start with “hearing the defendant, when this is possible”. According to the documents submitted to the file by his lawyers, Mario Iorgulescu is hospitalized in a clinic in Italy. Since August 2020, since the case was sent to court, he has not been able to be heard by any judge, not even via video conference.

At the previous term, on May 15, Iorgulescu’s lawyers told the court that Iorgulescu jr escaped from the clinic where he is hospitalized and, later, he was hospitalized again, forcibly, with the help of the carabinieri.

They announced that Gino Iorgulescu, the President of the Romanian Professional Football League, will also be present at the next term, as his son’s representative.

Iorgulescu’s lawyers requested a non-public meeting

Furthermore, the defendant’s lawyers requested the postponement of the case, so that Gino Iorgulescu could participate, but also the declaration of the non-public hearing.

“In support of the request to declare the meeting non-public, an aspect that was not included in the request submitted to the file would be that in the previous week, in the framework of a notification made to the CNA regarding what is happening on television, it was noted that the courts are the ones in a position to stop journalists’ access to the courtroom in order to no longer allow them to report truncated opinions”, says the conclusion from the last term.

In the end, the Court admitted the request to postpone the case, and with regard to the non-public declaration of the meeting, it announced that it will rule on the deadline of Monday, June 26.

The protest of the magistrates can lead to the postponement of the term

However, it is not known whether the case will be tried, after the decision of the judges of the Bucharest Court of Appeal to protest by postponing non-urgent cases against the government coalition’s intention to modify the legislation on special pensions.

The protest, which involves several courts in the country, was launched last week on June 21 and is still ongoing.

The file in the name of Mario Iorgulescu is not among the urgent cases in criminal matters that the CAB magistrates have indicated that they will continue to judge in Communication Courts.

However, the decision is with the judge and he will announce it in court today.

What the Court of Appeal might decide on the appeal

After judging the appeal, the court could give one of the following solutions:
rejecting the appeal, as unfounded, and upholding the conviction decision of the Bucharest Court;
admitting Mario Iorgulescu’s appeal or the one made by the prosecutors. In this case, the judges will either issue a new decision or decide to re-judge the case, and the file will return to the Bucharest Court.

Reasoning for the sentence of 15 years and 8 months in prison

In justifying the sentencing decision, the judge from the Bucharest Court specified that, on the night of the accident, when Mario Iorgulescu got behind the wheel, he relied exclusively on chance, and his actions “denote his complete indifference to the possible consequences of his own actions”.

How the fatal accident happened

In the evening of September 7, 2019, Gino Iorgulescu’s son went to a party in a town near Bucharest. The witnesses interviewed by the prosecutors stated that, around 3:00 a.m., after arguing with his ex-girlfriend, Mario Iorgulescu got behind the wheel and left for Bucharest. He was driving a car received as a gift from his father, worth 300,000 euros.

At the entrance to the Capital, with 143 km/h, as established by the investigators, Iorgulescu jr entered the opposite direction and hit another car head-on. It was led by Daniel Vicol, who died on the spot. Two children were then fatherless.

Also injured in the accident, Iorgulescu was admitted to the Elias Hospital. According to the accusation, the tests showed that he was under the influence of cocaine and had a blood alcohol level of 1.96 g/l. From the Elias Hospital, Mario Iorgulescu was transferred by his parents to a clinic in Italy.

On May 31, 2022, the Milan Court of Appeal rejected Mario Iorgulescu’s extradition request, because his mental state “is likely to prevent conscious participation in the process in an irreversible way”, the Italian magistrates stated.

“I don’t want to go back to Romania. I would like to be sentenced with a suspended sentence and serve my sentence in Italy”, declared the son of Gino Iorgulescu in November last year, in an interview for fanatik.ro, his first public appearance after the accident he caused.

Mario Iorgulescu has been pursued by the Romanian Police since May 2020.
